1. Acceptance of Terms
By accessing or using the Wealth Command Centre platform (the "Platform") operated by International Academy of Wealth Pty Ltd (ABN [CONFIRM]) ("IAW", "we", "us", or "our"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms in their entirety, you must immediately cease using the Platform.
These Terms constitute a legally binding agreement between you and IAW. Your continued use of the Platform following any modification to these Terms constitutes your acceptance of the revised Terms.
2. About the Platform
The Wealth Command Centre is a digital financial education and planning tool designed to assist members in organising their financial information, setting goals, and engaging with educational content provided by IAW. The Platform includes modules for net worth tracking, cash flow planning, asset allocation modelling, mortgage analysis, debt management, and related educational resources.
The Platform is an educational tool only. It does not provide financial advice, investment advice, tax advice, legal advice, or any other form of professional advice. Please refer to the Investment Disclaimer for the full scope of this limitation.
3. Eligibility
To use the Platform, you must: be at least 18 years of age; have the legal capacity to enter into a binding agreement; not be prohibited from using the Platform under any applicable law; and provide accurate, current, and complete information during registration and maintain the accuracy of that information.
IAW reserves the right to refuse access to the Platform to any person at its sole discretion.
4. Account Registration and Security
4.1 To access certain features of the Platform, you must create an account. You agree to provide truthful and accurate information when registering and to keep your account details current.
4.2 You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify IAW immediately at [email protected] if you suspect any unauthorised use of your account.
4.3 IAW will not be liable for any loss or damage arising from your failure to comply with this security obligation.
4.4 You may not share your account credentials with any third party or allow any third party to access the Platform through your account.
5. Subscription Plans and Payment
5.1 Subscription Tiers. The Platform is offered on a freemium basis. Certain modules and features are available at no cost ("Free Tier"). Access to premium features requires a paid subscription ("Paid Tier"). Current subscription plans, pricing, and inclusions are set out on the Platform's pricing page and may be updated from time to time.
5.2 Billing. All Paid Tier subscriptions are billed in Australian Dollars (AUD) unless otherwise specified. Payments are processed securely through Stripe. By subscribing to a Paid Tier, you authorise IAW to charge your nominated payment method on a recurring basis in accordance with your selected plan.
5.3 The Independence Plan. The Independence Plan commences upon payment of the initial enrolment fee of $995 AUD. At Day 30, you may elect to pay the annual balance ($9,000 AUD) in full or continue on a monthly subscription of $995 AUD per month for a minimum term of 12 months. Cancellation prior to the completion of the 12-month minimum term does not extinguish your obligation to pay the remaining monthly instalments.
5.4 Cancellation. You may cancel your subscription at any time through your account settings or by contacting IAW at [email protected]. Cancellation will take effect at the end of your current billing period. No refunds are provided for partial billing periods except where required by Australian Consumer Law.
5.5 Refunds. IAW's refund policy is governed by the Australian Consumer Law. Refunds are not provided for change of mind. Where a service is not fit for purpose or not as described, you may be entitled to a remedy under Australian Consumer Law. All refund requests must be submitted to [email protected].
5.6 Price Changes. IAW reserves the right to modify subscription pricing with at least 30 days' written notice to existing subscribers. Your continued use of the Platform after the effective date of a price change constitutes your acceptance of the new pricing.
6. Intellectual Property
6.1 All content on the Platform, including but not limited to text, graphics, logos, frameworks, methodologies, course materials, tools, software, and the Wealth Pyramid, The Sovereignty Path, Money Rules OS, The Cash Flow Code, and all other IAW intellectual property ("IAW IP"), is owned by or licensed to IAW and is protected by Australian and international copyright, trademark, and other intellectual property laws.
6.2 IAW grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform and its content solely for your personal, non-commercial educational purposes.
6.3 You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, transmit, or otherwise exploit any IAW IP without the prior written consent of IAW.
6.4 Any feedback, suggestions, or ideas you provide to IAW regarding the Platform may be used by IAW without restriction or compensation to you.
7. User Conduct
You agree that you will not: use the Platform for any unlawful purpose or in violation of any applicable law or regulation; use the Platform to transmit any material that is defamatory, offensive, harassing, or otherwise objectionable; attempt to gain unauthorised access to any part of the Platform or its related systems; use any automated means, including bots, scrapers, or crawlers, to access the Platform; reverse engineer, decompile, or disassemble any part of the Platform; interfere with or disrupt the integrity or performance of the Platform; impersonate any person or entity or misrepresent your affiliation with any person or entity; or use the Platform to solicit, advertise, or promote any third-party products or services without IAW's prior written consent.
8. User-Generated Content
8.1 The Platform may allow you to input, store, and manage personal financial data ("User Data"). You retain ownership of your User Data. By inputting User Data into the Platform, you grant IAW a limited licence to process and store that data solely for the purpose of providing the Platform's services to you.
8.2 You are solely responsible for the accuracy, completeness, and legality of your User Data. IAW does not verify, endorse, or take responsibility for any User Data.
8.3 IAW does not access, review, or use your personal financial data for any purpose other than delivering the Platform's functionality to you, except as set out in the Privacy Policy.
9. Third-Party Services and Links
The Platform may integrate with or contain links to third-party services, including payment processors, CRM platforms, and partner services. IAW is not responsible for the content, privacy practices, or terms of any third-party service. Your use of any third-party service is governed by that party's terms and conditions.
10. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
IAW does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. IAW does not warrant the accuracy, completeness, or reliability of any content on the Platform.
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition implied or imposed by the Australian Consumer Law that cannot lawfully be excluded.
11. Limitation of Liability
11.1 To the maximum extent permitted by applicable law, IAW's total liability to you for any loss or damage arising out of or in connection with your use of the Platform (whether in contract, tort, statute, or otherwise) shall not exceed the total amount paid by you to IAW in the 12 months immediately preceding the event giving rise to the claim.
11.2 In no event shall IAW be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or loss of investment returns, even if IAW has been advised of the possibility of such damages.
11.3 Nothing in these Terms limits or excludes IAW's liability for fraud, wilful misconduct, or any liability that cannot be excluded under the Australian Consumer Law.
12. Indemnification
You agree to indemnify, defend, and hold harmless IAW and its directors, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Platform; (b) your breach of these Terms; (c) your violation of any applicable law; or (d) any User Data you submit to the Platform.
13. Termination
13.1 IAW may suspend or terminate your access to the Platform at any time, with or without notice, if you breach these Terms or if IAW determines, in its sole discretion, that your continued access is not in the interests of IAW or its members.
13.2 Upon termination, your licence to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including Sections 6, 10, 11, 12, and 15.
14. Modifications to the Platform
IAW reserves the right to modify, suspend, or discontinue the Platform (or any part thereof) at any time with or without notice. IAW shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Platform.
15. Governing Law and Dispute Resolution
15.1 These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland and the Federal Court of Australia.
15.2 Before commencing any legal proceedings, you agree to notify IAW in writing of the dispute and to attempt to resolve it in good faith within 30 days.
16. General
16.1 Entire Agreement. These Terms, together with the Privacy Policy and Investment Disclaimer, constitute the entire agreement between you and IAW with respect to the Platform and supersede all prior agreements.
16.2 Severability. If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
16.3 Waiver. IAW's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
16.4 Assignment. You may not assign your rights or obligations under these Terms without IAW's prior written consent. IAW may assign its rights and obligations without restriction.
